Welcome to Smartalk. By accessing, booking, or purchasing our services, you agree to be bound by the following Terms and Conditions. These Terms apply to all clients and are intended to ensure clarity, fairness, and proper use of our services.
1. Services Provided
Smartalk provides online English coaching and training for entrepreneurs, professionals, and ESL students. Our coaches are experienced and committed to guiding each client through a structured and personalized learning process. While every effort is made to support improvement and achieve results, the success of the program depends on the client's active participation, practice, and dedication. Smartalk does not provide official language certifications, nor does it guarantee specific outcomes within a predetermined timeframe.
2. Booking and Cancellations
All bookings, rescheduling, and cancellations are subject to our official policy, available here: policy. Clients are responsible for familiarizing themselves with this policy before booking services.
3. Payments
Smartalk issues invoices for all services, which must be settled in advance. Coaching packages, once initiated, are non-refundable, except in exceptional and duly documented circumstances. By making a payment, the client confirms acceptance of these terms.
4. Use of Materials and Sessions
All materials provided during the coaching process are the exclusive property of Smartalk and are supplied solely for personal and individual use. Clients may not copy, distribute, resell, or otherwise make such materials available to third parties without prior written consent.
All sessions are held via Google Meet. Recording of sessions is strictly prohibited unless expressly authorized in writing by Smartalk.
5. Responsibilities and Limitations
Smartalk ensures that sessions are delivered in a professional manner and with appropriate preparation. However:
- Smartalk is not responsible for technical issues related to the client's internet connection, devices, or third-party platforms (including Google Meet).
- Smartalk shall not be liable for indirect, incidental, or consequential damages arising from the use of the services.
- Learning outcomes depend on multiple factors, including client commitment, and cannot be contractually guaranteed.
6. Personal Data (Privacy)
Smartalk collects and processes personal data (such as name, email, contact details, and payment information) exclusively for administrative purposes and for the proper delivery of services. Data will never be sold or shared with third parties, except where required by law. By using our services, clients consent to the collection and responsible use of their personal data as described herein.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Italy. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Court of Treviso, Italy.
8. Changes to Terms
Smartalk reserves the right to modify or update these Terms and Conditions at any time. Any changes will become effective immediately upon publication on our website. Continued use of the services after such updates constitutes acceptance of the revised Terms.
